Introduction
Welcome to the Kemyshopping Affiliate Program. By signing up as an affiliate, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before registering.

1. Eligibility
1.1. Age Requirement: You must be at least 18 years old to participate in the Kemyshopping Affiliate Program.

1.2. Account Approval: All affiliate applications are subject to approval by Kemyshopping. We reserve the right to reject any application for any reason, at our sole discretion.

2. Affiliate Links and Promotion
2.1. Affiliate Link Usage: You will be provided with a unique affiliate link upon approval. This link must be used to track sales and vendor registrations accurately.

2.2. Promotion Methods: You may promote your affiliate link through social media, websites, blogs, email newsletters, and other lawful channels. Any promotion methods that are deemed inappropriate or misleading may result in termination of your affiliate account.

2.3. Prohibited Actions: Affiliates are prohibited from:

Using false or misleading claims in their promotional efforts.
Spamming (unsolicited commercial emails).
Engaging in fraudulent activities or generating fake sales or vendor registrations.
Using paid advertising to bid on Kemyshopping’s trademarks or misspellings thereof.
3. Commission Structure
3.1. Sales Commission: Affiliates will earn a commission of 3% on every sale made through their affiliate link.

3.2. Vendor Registration Commission: Affiliates will receive a one-time payment of R30 for every new vendor who registers using their affiliate link, plus 1% of the sales generated by that vendor.

3.3. Commission Validity: Commissions are only earned on legitimate sales and registrations. Any returned or refunded sales will not qualify for commission.

4. Payment Terms
4.1. Payments: Commissions are typically paid out every two weeks. Ensure that your payment information is up to date to receive timely payments.

4.1.2. Affiliate Payment Condition: Affiliates will receive a once-off R30 commission only if the referred vendor sells at least one product. This ensures that commissions are paid out for active and contributing vendors on KemyShopping.

4.2. Minimum Payout Threshold: Affiliates must reach a minimum commission balance of R200 before a payout is issued. Balances below this threshold will roll over to the next month.

4.3. Payment Methods: Payments will be made via bank transfer or any other method agreed upon by Kemyshopping and the affiliate.

4.4. Account Information: Affiliates are responsible for ensuring that their payment information is accurate and up to date. Kemyshopping is not responsible for any delays or losses due to incorrect payment information.

5. Affiliate Responsibilities
5.1. Compliance with Laws: Affiliates must comply with all applicable laws and regulations, including but not limited to advertising laws and data protection regulations.

5.2. Content Ownership: Affiliates are responsible for the content they create and publish. Kemyshopping is not liable for any content published by affiliates.

5.3. Confidentiality: Affiliates must not disclose any confidential information provided by Kemyshopping, including but not limited to commission rates, marketing strategies, and proprietary data.

6. Termination
6.1. Voluntary Termination: Affiliates may terminate their participation in the affiliate program at any time by providing written notice to Kemyshopping.

6.2. Involuntary Termination: Kemyshopping reserves the right to terminate any affiliate account at its discretion, particularly in cases of fraud, violation of these terms and conditions, or any behavior deemed harmful to Kemyshopping.

6.3. Effect of Termination: Upon termination, affiliates will forfeit any unpaid commissions. Affiliates must immediately cease using their affiliate links and remove any promotional content related to Kemyshopping.

7. Limitation of Liability
7.1. No Warranty: Kemyshopping makes no express or implied warranties regarding the affiliate program or any products sold through the program.

7.2. Liability Limitation: Kemyshopping’s liability for any damages, losses, or claims arising from the affiliate program is limited to the total commissions earned by the affiliate in the preceding 12 months.

8. Modifications
8.1. Terms and Conditions Changes: Kemyshopping reserves the right to modify these terms and conditions at any time. Affiliates will be notified of any significant changes via email or through the affiliate dashboard.

8.2. Continued Participation: Continued participation in the affiliate program after any modifications constitutes acceptance of the revised terms and conditions.

9. Governing Law
9.1. Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of South Africa.
