Welcome to Kemyshopping. By registering as a vendor on our platform, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before registering.

1. Eligibility
1.1. Legal Capacity: You must be at least 18 years old and have the legal capacity to enter into binding agreements to register as a vendor on Kemyshopping.

1.2. Approval: All vendor applications are subject to approval by Kemyshopping. We reserve the right to reject any application for any reason, at our sole discretion.

2. Vendor Account
2.1. Registration: Complete the vendor registration form with accurate and truthful information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2. Profile Information: Keep your vendor profile information up to date, including your business name, contact details, and payment information.

3. Listing Products
3.1. Product Compliance:

General Compliance: All products listed for sale must comply with Kemyshopping’s policies, as well as all applicable laws and regulations. Prohibited items may not be listed.
Prohibited Items: The following items are strictly prohibited from being listed on Kemyshopping:
Illegal products, including counterfeit or stolen goods.
Hazardous materials, including explosives, flammable items, and toxic substances.
Offensive materials, including those that promote hate, violence, or discrimination.
Adult content, including pornography and sexually explicit materials.
Prescription drugs, narcotics, and other controlled substances.
Firearms, ammunition, and weapons.
Products that infringe on intellectual property rights, including pirated media and counterfeit goods.
Live animals and endangered species.
Government-issued IDs, licenses, and uniforms.
Recalled or defective products that do not meet safety standards.
Quality Standards: Products must meet the quality standards set by Kemyshopping and be accurately described. Misleading information, including false claims about the product’s condition, origin, or functionality, is prohibited.
Legal Requirements: Vendors are responsible for ensuring that their products comply with all applicable local, national, and international laws and regulations, including safety, labeling, and consumer protection laws.
3.2. Product Descriptions: Provide accurate and detailed descriptions for each product, including pricing, specifications, and images. Misleading information is strictly prohibited.

3.3. Inventory Management: Ensure that your listed products are in stock and available for delivery. Promptly update your inventory status to avoid customer dissatisfaction.

4. Sales and Order Fulfillment
4.1. Order Processing: Process orders promptly and ensure timely shipment of products. Communicate with customers regarding order status and any potential delays.

4.2. Shipping and Delivery: Use reliable shipping methods and provide accurate shipping estimates. You are responsible for ensuring that products are delivered to customers in a timely manner.

4.3. Customer Service: Provide excellent customer service, including handling inquiries, complaints, and returns. Maintain a high level of professionalism in all customer interactions.

5. Fees and Payments
5.1. Commission: Kemyshopping charges a commission on each sale made through the platform. The current commission rate is 10% of the sale price.

5.2. Payment Schedule: Payments for sales will be disbursed on a monthly basis, typically within 30 days of the end of the month in which the sales were made.

5.3. Transaction Fees: Any applicable transaction fees, such as payment processing fees, will be deducted from your payments.

5.4. Payout Information: Ensure that your payout information is accurate and up to date to receive timely payments.

6. Vendor Responsibilities
6.1. Compliance with Laws: Vendors must comply with all applicable laws and regulations, including consumer protection, product safety, and data protection laws.

6.2. Intellectual Property: Ensure that you have the necessary rights to sell your products, including any required intellectual property rights. Do not infringe on the intellectual property rights of others.

6.3. Confidentiality: Maintain the confidentiality of any proprietary information provided by Kemyshopping, including but not limited to customer data and business strategies.

7. Prohibited Activities
7.1. Fraud and Misrepresentation: Engaging in fraudulent activities, providing false information, or misrepresenting your products is strictly prohibited.

7.2. Unfair Practices: Any practices that are deemed to be unfair or harmful to the Kemyshopping community, including manipulating ratings and reviews, are prohibited.

7.3. Spam: Sending unsolicited commercial messages or engaging in spamming activities is not allowed.

8. Termination
8.1. Voluntary Termination: Vendors may terminate their participation on Kemyshopping at any time by providing written notice to Kemyshopping.

8.2. Involuntary Termination: Kemyshopping reserves the right to terminate any vendor account at its discretion, particularly in cases of violation of these terms and conditions or any behavior deemed harmful to the platform.

8.3. Effect of Termination: Upon termination, vendors must fulfill any outstanding orders and cease using the platform. Any outstanding fees or commissions will still be payable.

9. Limitation of Liability
9.1. No Warranty: Kemyshopping makes no express or implied warranties regarding the platform or the services provided.

9.2. Liability Limitation: Kemyshopping’s liability for any damages, losses, or claims arising from the vendor’s use of the platform is limited to the total fees paid by the vendor in the preceding 12 months.

10. Modifications
10.1. Terms and Conditions Changes: Kemyshopping reserves the right to modify these terms and conditions at any time. Vendors will be notified of any significant changes via email or through their vendor dashboard.

10.2. Continued Participation: Continued participation on Kemyshopping after any modifications constitutes acceptance of the revised terms and conditions.

11. Governing Law
11.1. Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of South Africa.
